What are the on-the-spot fines?


Some offences under Queensland’s tobacco laws are enforced by on-the-spot fines.

On-the-spot fines

$150 on-the-spot fines will be issued to anyone found smoking in the new no-smoking zones.

The table below shows which offences can attract on-the-spot fines, who can be fined and the fine amount.

Offences not listed in this table, such as a licensee allowing patrons to smoke in a no-smoking area, may be prosecuted through a Magistrate’s Court, with maximum penalties of up to $10,500 from 1 July 2006.

If you are smoking in a no-smoking zone and approached by an authorised Queensland Health Officer, you are, by law, required to provide your correct name and address to the officer.

Liquor licensed restaurants and other liquor licensed premises

Non-liquor licensed food and drink businesses

Tobacco retailing
