Food Act 2006 - Prosecutions

Queensland Health and Queensland local governments undertake prosecutions against individuals or companies that have breached the Food Act 2006.

Queensland Health will publish on this webpage a summary of convictions against the Food Act 2006, except where a conviction has not been recorded, a court has made a non-publication order, or the case is within the appeal period or subject to appeal.

Prosecutions that will be published on this website include convictions undertaken by Queensland Health.  These may include offences related to unsafe or unsuitable food, the false description of food, misleading conduct relating to the sale of food, sale of unfit equipment or packaging or labelling material, or for breaches of the Australia New Zealand Food Standards Code related to the composition, labelling and advertising of food.

Prosecutions of food businesses, which are undertaken by local governments, may also be included, when this information is provided to Queensland Health by a local government.  These offences will mostly be in relation to unsafe or unsuitable food, the carrying on of a licensable food business and breaches of the Food Safety Standards which form part of the Australia New Zealand Food Standards Code.  It is an offence under the Food Act 2006 to not comply with the Food Safety Standards.

The information on each case will only be published on this website for a period of two years.

Due to confidentiality obligations under the Food Act 2006, Queensland Health will not be able to provide any additional information regarding the prosecutions listed in the following table.
