Legal Review Requirements

Legal review includes the review of contractual arrangements such as Clinical Trial Agreement, Indemnity and Insurance arrangements. A Contract, Indemnity and Insurance Policy are required if any of the following apply to an application submitted to the Human Research Ethics Committee:

• The research will involve a third party such as a pharmaceutical company or a research organisation
• The Principal Investigator is / is not a Queensland Health employee
• The Principal Investigator is a University employee or the research is conducted by a student.

Legal Agreements
General Guidelines

• All research involving Queensland Health staff, premises, resources or patients must be the subject of a written research contract. Refer to the Queensland Health Research Management Policy & Framework 2008.
• A Principal Investigator must be nominated prior to commencement of a study. If the Principal Investigator is not a staff member, a staff member must be nominated as a 'local onsite sponsor'.
• The contract must be made between the "The State of Queensland Acting Through Queensland Health via the Princess Alexandra Hospital" (ABN: 66 329 169 412) and the third party.
• The Principal Investigator cannot be a party to the Agreement.
• The Contract, Indemnity and the Insurance Policy should be submitted at the same time as the Research Protocol.

The Legal Entity entering into the agreement is The State of Queensland acting through Queensland Health.  The hospital is not a legal entity.  It is important that the correct legal entity is included exactly as outlined below on both the cover page of the Clinical Trial Agreement and the signature page.
