Termination of pregnancy legislation

From 3 December 2018, the Termination of Pregnancy Act 2018 ensures termination of pregnancy is treated as a health issue rather than a criminal issue.The Act:

  • supports a woman's right to health, including reproductive health and autonomy
  • provides clarity and safety for health practitioners providing terminations of pregnancy
  • brings Queensland legislation in line with other Australian jurisdictions.

The Act was the result of an independent review and investigation into modernising Queensland's laws relating to the termination of pregnancy by the Queensland Law  Reform Commission (QLRC). The QLRC provided a report and draft legislation based on its recommendations, to the Attorney-General on 30 June 2018. This was accepted by the Government, along with the 28 recommendations in the report.
