Notice of the Chief Health Officer in accordance with particular powers arising from a public health emergency order

Section 362F
On 29 January 2020, under the Public Health Act 2005, the Minister for Health and Minister for Ambulance Services made an order declaring a public health emergency in relation to coronavirus disease (COVID-19 emergency). The public health emergency area specified in the order is for ‘all of Queensland’. Its duration has been extended by regulation to 19 May 2020.
Further to this declaration, l, Dr Jeannette Young, Chief Health Officer, to respond to the COVID-19 emergency, publish the following notice pursuant to section 362F of the Public Health Act 2005 (Qld):
PART 1 – TRADING HOURS
The purpose of this Part is to enable owners or operators of businesses to open the business outside the hours allowable pursuant to the Trading (Allowable Hours) Act 1990, or limit access to the business.
Recommendations
- An owner or operator of a business used predominantly for the sale of food or groceries or both, is permitted to open the business from 7am on a day the shop is permitted to trade, to enable people to obtain essential groceries, between 19 March 2020 and the end of the COVID-19 emergency.
- During the period for which recommendation 1 applies, an owner or operator of a business used predominantly for the sale of food or groceries or both, is permitted to limit access to the business to persons or certain classes of persons, for example customers holding a pensioner concession card, so that person can purchase essential grocery items in way that upholds the health and safety of that person or class of persons.
- Subject to Recommendations 1 and 2 the allowable trading hours prescribed in the Trading (Allowable Hours) Act 1990 continue to apply.
Definitions
For the purposes of the notices in paragraphs 1 and 2:
- Business includes a shop.
