Direction from Chief Health Officer in accordance with emergency powers arising from the declared public health emergency

Public Health Act 2005 (Qld)

Section 362B

On 29 January 2020, under the Public Health Act 2005, the Minister for Health and Minister for Ambulance Services made an order declaring a public health emergency in relation to coronavirus disease (COVID-19). The public health emergency area specified in the order is for ‘all of Queensland’. Its duration has been extended by regulation to 26 March 2021 and may be further extended.

Further to this declaration, l, Dr John Gerrard, Chief Health Officer, reasonably believe it is necessary to give the following direction pursuant to the powers under s 362B of the Public Health Act 2005 to assist in containing, or to respond to, the spread of COVID-19 within the community.

Preamble

The purpose of this Direction is to protect the health of the community and air crew by mitigating the risk of the spread of COVID-19 through quarantine and COVID-19 testing of air crew.

Guidance

A person entering Queensland under this Direction must comply with any relevant requirements of other Public Health Directions while the person is in Queensland.

Separately from the requirements under Public Health Directions, under sections 362G and 362H of the Public Health Act 2005, a person may be given a direction by an emergency officer (public health) to stay at or in a particular place for up to 14 days if the emergency officer believes it is reasonably necessary to assist in containing, or to respond to, the spread of COVID-19 in the community.

Citation

  1. This Public Health Direction may be referred to as the Quarantine and COVID-19 Testing for International Air Crew Direction.

Revocation

  1. The Quarantine and COVID-19 Testing for Air Crew Direction (No. 2) made on 6 May 2021 is revoked from the time of publication of this Direction.

Commencement

  1. This Direction applies from the time of publication until the end of the declared public health emergency, unless revoked or replaced.

PART 1 – QUEENSLAND INTERNATIONAL ARRIVALS REGISTRATION

  1. This part applies to Queensland-based international air crew, international air crew and Australian Defence Force air crew who arrive in Queensland and who have been in a place outside Australia in the 14 days immediately before their arrival.

  2. A person mentioned in paragraph 4 must apply for and receive a Queensland International Arrivals Registration and must declare:

    1. the person’s name, date of birth, primary residential address in Australia, phone number and email address; and

    2. if requested, satisfactory evidence of identity; and

      Examples of evidence of identity – Passport, driver licence, Medicare card

    3. whether the person is an unaccompanied minor; and

    4. travel details including arrival date in Queensland; and

    5. any other information or documents required by an emergency officer (public health) or required for the Queensland International Arrivals Registration.

  3. Despite paragraph 5, Queensland-based international air crew, international air crew and Australian Defence Force air crew who have only been in a safe travel zone country in the 14 days prior to arriving in Queensland and have travelled to Queensland on a quarantine-free flight are not required to apply for a Queensland International Arrivals Registration.

PART 1A – GENERAL REQUIREMENTS FOR AIR CREW ARRIVING FROM OVERSEAS

  1. This Direction applies to Queensland-based international air crew, Australian Defence Force air crew and international air crew who arrive in Queensland and who have been in a place outside Australia in the 14 days immediately before their arrival.

    Note: The requirements in the Direction do not apply to air crew who have travelled to Queensland on a quarantine-free flight from a safe travel zone country. However, these air crew may be asked general screening questions under the Quarantine for International Arrivals Direction (No. 18) or its successors.

  2. Queensland-based international air crew, Australian Defence Force air crew and international air crew must quarantine in nominated premises in accordance with Part 2 for 14 days commencing on the date of their arrival to Queensland, unless the person departs Queensland on an assigned flight duty before completion of the 14 day quarantine period.

  3. An airline operator must ensure that:

    1. appropriate transportation that complies with the Operational Guideline for Air Crew is available for Queensland-based international air crew, Australian Defence Force air crew or international air crew to travel to and from a nominated premises; and

    2. Queensland-based international air crew, Australian Defence Force air crew or international air crew travel directly to their nominated premises from their port of arrival without stopping; and

    3. any Queensland-based international air crew, Australian Defence Force air crew or international air crew leaving quarantine to depart Queensland on an assigned flight duty, must travel directly from their nominated premises to their port of departure without stopping.

  4. Queensland-based international air crew engaged by an approved airline or Australian Defence Force air crew who arrive in Queensland from a place outside Australia may quarantine at a residence or military base in Queensland if the following requirements can be met:

    1. the person can comply with the Operational Guidelines for Air Crew; and

    2. if the person is a member of positioning crew, they can provide evidence that they are a member of positioning crew; and

    3. the person has not been otherwise directed by an emergency officer (public health).

  5. Fully vaccinated Queensland-based international air crew engaged by an approved airline or Australian Defence Force air crew who arrive in Queensland on a direct flight from a place outside Australia, or arrives on a domestic on-travel flight from another State or Territory and who on arrival in the other State or Territory did not leave the confines of the airport or quarantined at their port of entry in either government nominated hotel accommodation or air crew accommodation until boarding the domestic flight, may quarantine at a residence or military base in Queensland if the following requirements can be met:

    1. the person can comply with the Operational Guidelines for Air Crew; and

    2. if the person is a member of positioning crew, they can provide evidence that they are a member of positioning crew; and

    3. the person has not been otherwise directed by an emergency officer (public health); and

    4. if the person arrives on a domestic on-travel flight and quarantined at their port of entry, the person has undertaken a COVID-19 test and received a negative test result within 24 hours prior to departing the other State or Territory.

  6. Queensland-based international air crew and Australian Defence Force air crew quarantining at a residence or military base, after completing immigration, customs and any other requirements must:

    1. travel directly, from their port of disembarkation to their residence or military base:

      1. using private transport; and

        Note: air crew must travel by private vehicle whenever practicable. An airline operator should ensure air crew travel to and from their residence by private vehicle whenever practicable.

      2. for a distance of no more than two hours safe driving distance from their port of disembarkation; and

      3. without stopping; and

    2. strictly comply with the quarantine requirements in Part 2; and

    3. strictly comply with the Operational Guidelines for Air Crew.

  1. Queensland-based international air crew and Australian Defence Force air crew who do not have private transport available to travel from their port of disembarkation to their residence must travel by an endorsed transport provider.

  2. Each airline operator must develop a Compliance Plan outlining the measures that will be taken by the airline operator to ensure Queensland-based international air crew comply with:

    1. home quarantine requirements under paragraphs 10 and 11; and

    2. surveillance testing requirements; and

    3. requirements under the Operational Guidelines for Air Crew; and

    4. all other requirements under relevant Public Health Directions.

  3. An airline operator must provide a copy of their Compliance Plan to an emergency officer (public health) on request and if requested, evidence to demonstrate how the airline operator is implementing the measures in the Compliance Plan.

  4. Queensland-based international air crew and international air crew arriving in Queensland on a freight flight or ferry flight from a place outside Australia are permitted to take a domestic on-flight to another destination in Queensland or another State or Territory if they can provide the following to an emergency officer (public health):

    1. written confirmation from the airline operator that the person has travelled on a freight flight or a ferry flight; and

    2. if the flight is travelling to another State or Territory, written confirmation from the relevant government agency from the receiving State or Territory that the person has permission to enter the State or Territory; and

    3. an undertaking the person has not left the confines of the airport at their port of arrival in Queensland and had no contact with members of the community, other than those they travelled with or may have come into contact with at the airport.

    Note: Unvaccinated air crew seeking to stay overnight at their port of arrival in Queensland before repositioning to their next destination will require an exemption to leave quarantine under Part 6.

  1. Fully vaccinated Queensland-based international air crew, international air crew and Australian Defence Force air crew travelling on a return freight flight or ferry flight to an international port and upon arrival at the international port remain on the aircraft or only disembark for contactless refuelling or to conduct a safety check, do not need to quarantine upon arrival in Queensland.

  2. Queensland-based international air crew, Australian Defence Force air crew and international air crew who have been in a place outside Australia in the 14 days immediately before their arrival in Queensland are permitted to travel from Queensland to another State or Territory on a domestic flight if the following apply:

    1. the person travels from either their port of arrival or residence to board the flight in accordance with paragraph 25 and 27 without stopping; and

    2. the person on arrival at another State or Territory will immediately depart Australia on an outbound international flight; and

    3. the person travels on a crew-only flight.

  3. Fully vaccinated Queensland-based international air crew, Australian Defence Force Air Crew and international air crew who have been in a place outside Australia in the 14 days immediately before their arrival in Queensland are permitted to travel from Queensland to another State or Territory on a domestic flight if the following apply:

    1. the person travels from either their port of arrival or residence to board the flight in accordance with paragraph 21 and 23 without stopping; and

    2. the person on arrival at another State or Territory will immediately depart Australia on an outbound international assigned flight duty.

  4. Queensland-based international air crew and international air crew arriving in Queensland on an aeromedical flight from a place outside Australia are permitted to take a domestic aeromedical on-flight to another destination in Queensland to complete a patient transfer if the following requirements can be met:

    1. the first port of arrival in Queensland is for a contactless fuel stop and customs only; and

    2. the crew comply with any surveillance testing requirements under this Direction; and

    3. the air crew and passengers remain on the aircraft or only disembark for contactless refuelling or to conduct a safety check; and

    4. on arrival to the destination in Queensland for patient transfer, the crew do not leave the confines of the airport, unless required to quarantine in government nominated accommodation before the return flight; and

    5. the return flight is a crew-only flight and no crew members join the aircraft for the return flight.

  5. Fully vaccinated Queensland-based international air crew and international air crew arriving in Queensland on flight from a place outside Australia are permitted to take a domestic on-flight to another destination in Queensland or another State or Territory if the following requirements can be met:

    1. the first port of arrival in Queensland is for a contactless fuel stop or customs only; and

    2. the air crew comply with any surveillance testing requirements under this Direction; and

    3. the air crew remain on the aircraft or only disembark for contactless refuelling or to conduct a safety check; and

    4. on arrival to the first destination in Queensland the air crew do not leave the confines of the airport, unless required to quarantine in government nominated accommodation or air crew accommodation before the on-flight; and

    5. the air crew undertake a COVID-19 test and receive a negative test result within 24 hours prior to onward travel.

PART 2 – QUARANTINE REQUIREMENTS

  1. A person who is required to quarantine under this Direction must not leave the nominated premises for 14 days, except:

    1. to depart Queensland on an assigned flight duty, as permitted under Part 1B; or

    2. for the purposes of obtaining essential medical care at a hospital; or

    3. to avoid injury or illness or to escape a risk of harm; or

      Example – escaping a risk of harm related to sexual or domestic and family violence; or accessing support from a domestic and family violence support service

    4. in the event of an emergency situation; or

    5. for Queensland-based international air crew with a primary place of residence in Queensland, to carry out mandatory training and assessment within Queensland which is required to be undertaken in-person to ensure that flight crew meet regulatory requirements to operate aircraft or to ensure safety of flights; or

      Example: flight simulation training or the components of essential safety and security training that must be undertaken in person, including training that may be carried out while the person is not on their usual work shift or duty.

    6. for Australian Defence Force air crew, to carry out mandatory training and assessment within Queensland which is required to be undertaken by the Australian Defence Force; or

    7. to undertake a COVID-19 PCR test; or

    8. as otherwise required or permitted under a direction given to the person by an emergency officer (public health); and

  2. A person directed to quarantine at government-nominated accommodation or air crew accommodation, must not open the door to the nominated premises, except:

    1. for a permitted purpose under paragraph 22; or

    2. when permitted by a quarantine facility worker to collect any food, laundry, medical supplies or other items left at the door of their nominated premises by a quarantine facility worker; or

    3. when permitted by a quarantine facility worker to place any laundry, rubbish or other items directly outside the door of their nominated premises for collection by a quarantine facility worker; or

    4. when permitted by an emergency officer (public health) to be tested for COVID-19; and

  3. A person directed to quarantine at government-nominated accommodation or air crew accommodation, must not:

    1. physically interact with other guests from another nominated premises on a balcony of the nominated premises; or

      Note: a quarantined person should maintain physical distancing from other guests on other balconies at government-nominated accommodation.

    2. accept or exchange items with other guests between balconies at government-nominated accommodation; or

    3. enter any balcony other than a balcony of the person’s nominated premises; and

  4. A person who is required to quarantine under this Direction must wear a surgical mask:

    1. whenever directed to do so by an emergency officer (public health); and

    2. whenever on a balcony of the nominated premises at government-nominated accommodation; and

    3. when travelling to and from the nominated premises for the purposes of commencing quarantine or leaving quarantine prior to completing 14 days to depart on an assigned international flight duty; and

    4. when leaving and returning to the nominated premises during quarantine as permitted under paragraph 22 or whenever the door to the nominated premises is open as permitted under paragraph 23, unless:

      1. it is not practicable due to the need to avoid immediate injury or illness or to escape a risk of harm; or

      2. it is not practicable because of the emergency situation; or

      3. the person has a physical or mental health illness or condition, or disability, which makes wearing a surgical mask unsuitable; or

        Examples: persons who have obstructed breathing, a serious skin condition on their face, an intellectual disability, a mental health illness, or who have experienced trauma.

      4. permitted under a direction given to the person by an emergency officer (public health); and

  5. A person who leaves the nominated premises during the quarantine period under paragraph 22 (a) must travel by ambulance service or endorsed transport provider.

  6. A person who leaves and returns to the nominated premises during quarantine as permitted under paragraphs 22 (b) to (h) must travel by ambulance service or endorsed transport provider.

  7. for Queensland-based international air crew or Australian Defence Force air crew quarantining at a residence, private transport in accordance with the Operational Guidelines for Air Crew; or

  8. an emergency services vehicle in emergency as permitted under a direction given to the person by an emergency officer (public health).

  9. A person who is required to quarantine under this Direction must not permit any other person to enter the nominated premises unless that other person:

    1. resides in the nominated premises with a person who is Queensland-based international air crew or Australian Defence Force air crew; or

    2. is required or permitted under a direction given to a person by an emergency officer (public health) to conduct a COVID-19 test; or

    3. for government-nominated accommodation, is required or permitted under a direction given to the person by an emergency officer (public health) in an emergency and contact details of the other person are recorded; or

      Example: an emergency medical situation where it is not practicable to transport the quarantined person to a hospital.

      Note: A nominated premises includes the balcony of a government-nominated hotel room. A quarantined person must not permit any person to enter their balcony unless they are permitted by paragraph 28.

    4. for a residence, is required to enter to conduct a COVID-19 PCR test or in an emergency situation; and

  10. A person who is required to quarantine under this Direction will quarantine for a further period of 14 days from the end of the quarantine period if the person does not comply with surveillance testing or other requirements of this Direction.

    Note: Under sections 362G and 362H of the Public Health Act 2005, an emergency officer (public health) can give a direction to a person to stay at or in a particular place for up to 14 days if the emergency officer believes the direction is reasonably necessary to assist in containing, or to respond to, the spread of COVID-19 in the community.

  11. If a person who is required to quarantine under this Direction develops symptoms consistent with COVID-19, they must:

    1. immediately contact Queensland Health for medical attention; and

    2. be tested for COVID-19 and isolate until a negative test result is received and they are symptom-free.

PART 3 – COVID-19 TESTING OF AIR CREW

  1. International air crew quarantining at a nominated premises must undertake surveillance testing for COVID-19 conducted by a relevant authority.

  2. Queensland-based international air crew quarantining at a nominated premises must undertake surveillance testing for COVID-19.

  3. Each airline operator must keep records of surveillance testing of Queensland-based international air crew, and international air crew and provide these records to an emergency officer (public health) on request.

  4. Queensland-based international air crew or international air crew who are tested for COVID-19 in accordance with paragraph 31 or 32 are permitted to leave quarantine for their next assigned flight duty while awaiting a test result, unless required to isolate under another law or direction, provided they:

    1. for international air crew, comply with quarantine requirements under paragraph 24; and

    2. do not have symptoms consistent with COVID-19.

    Example: A Queensland-based international air crew member may be directed to isolate for another reason such as being identified as a close contact of a person with COVID-19.

PART 4 – SCREENING AND EVIDENTIARY PROVISIONS

  1. An emergency officer (public health) may require any person subject to this Direction to answer questions or provide evidence about:

    1. whether the person has symptoms consistent with COVID-19; and

    2. whether they have been knowingly exposed to COVID-19 in the past 14 days; and

    3. their name; and

    4. their date of birth; and

    5. their phone number while in Australia; and

    6. their intended address while in Australia; and

    7. their email address; and

    8. their flight number; and

    9. their flight seat number; and

    10. the places the person has been in the 14 days before arriving in Queensland; and

    11. for Queensland-based international air crew with a primary place of residence in Queensland, evidence of the essential and mandatory nature of training or assessment required to be completed during quarantine.

PART 5 – OTHER MATTERS

  1. An emergency officer (public health) can give a direction to a Queensland-based international air crew member or an international air crew member about the conduct of a COVID-19 test.

  2. An emergency officer (public health) can require an airline operator to comply with additional directions if the emergency officer believes the direction is reasonably necessary to assist in containing, or to respond to, the spread of COVID-19 within the community.

PART 6 – EXEMPTIONS

  1. The Chief Health Officer, the Deputy Chief Health Officer or their delegate may grant a person an exemption from all or part of these directions on the basis of extreme exceptional circumstances.

  2. An exemption may be given on conditions and if so, the person given the exemption must comply with the conditions.

PART 7 – DEFINITIONS

  1. Definitions used in this Direction are in Schedule 1.

PART 8 – PENALTIES

A person to whom the direction applies commits an offence if the person fails, without reasonable excuse, to comply with the direction.

Section 362D of the Public Health Act 2005 provides:

Failure to comply with public health directions

  • A person to whom a public health direction applies must comply with the direction unless the person has a reasonable excuse.
  • Maximum penalty—100 penalty units or 6 months imprisonment.

SCHEDULE 1 – DEFINITIONS

For the purposes of this Public Health Direction:

Air crew accommodation means accommodation provided by an airline for air crew to quarantine at.

Airline operator means the person, business or entity that owns, controls or operates an aircraft arriving in Queensland from a point of origin outside of Australia.

Approved airline is an airline listed as an Approved airline in Schedule 2.

Australia means the Commonwealth of Australia and includes the external territories of Norfolk Island, Christmas Island, Cocos (Keeling) Islands, Coral Sea Islands and Heard and McDonald Islands but excludes the Australian Antarctic Territory.

Australian Defence Force air crew means

  1. an Australian Defence Force air crew member performing military tasking in accordance with a lawful order, excluding members ordinarily travelling for posting or leave purposes; or

  2. an off-shift Australian Defence Force air crew member travelling as a passenger on an aircraft to reposition at another location to immediately commence military tasking in accordance with a lawful order.

Compliance Plan means a plan developed by an airline operator that sets out the measures that will be taken to ensure Queensland-based international air crew comply with home quarantine and surveillance testing requirements under this Direction, the Operational Guidelines for Air Crew and all other requirements under relevant Public Health Directions.

Confines of the airport means the terminal or terminals of an airport used for the arrival and departure of aircraft and passengers by air, or the area of an airport that the person uses to transfer directly between terminals.

Example: a person did not leave the confines of the airport if they stay in a passenger terminal until their next flight or transferred directly between terminals to depart on their flight. However, a person leaves the confines of the airport if they go to a hotel in the airport precinct and stay overnight.

COVID-19 hotspot means a particular area of Australia decided by the Chief Health Officer and published on the Queensland Health website (https://www.health.qld.gov.au/system-governance/legislation/cho-public-health-directions-under-expanded-public-health-act-powers/declared-hotspots-direction).

COVID-19 PCR test means an oropharyngeal and deep nasal swab for a polymerase chain reaction (PCR) test approved for use in Australia by the Therapeutic Goods Administration to detect whether a person has the COVID-19 virus.

Note: A COVID-19 PCR test does not include a self-test.

COVID-19 test means a COVID-19 PCR test or Rapid Antigen Test approved for use in Australia by the Therapeutic Goods Administration to detect whether the person has the COVID-19 virus.

Crew-only flight means a domestic flight travelling within Australia with:

  1. only Queensland-based international air crew, international air crew, Australian Defence Force air crew or domestic air crew on board; and

  2. no passengers on board.

Domestic air crew means an on-shift or off-shift air crew member who has serviced a crew-only flight in the last 14 days.

Emergency officer (public health) means an emergency officer appointed under the Public Health Act 2005.

Note: Emergency officers appointed under the Public Health Act 2005 include public health officers and police and includes emergency officers (medical) and emergency officer (general).

Endorsed transport provider means a person, business or entity that provides a transport service to a person who is required to quarantine and is endorsed by a government authority and has a Transport Plan in the form approved by the Chief Health Officer.

Ferry flight means an inbound flight to Australia transporting essential crew only with no passengers on board and that is associated with the aircraft’s delivery or movement to a location for maintenance, hire, or other planned use.

Freight means cargo or lading carried for pay either by land, water, or air.

Freight flight means a flight transporting freight and essential crew only, where no new crew members board the aircraft in a place outside of Australia.

Fully vaccinated means a person who is 16 years of age or older who has received the prescribed number of doses of a COVID-19 vaccine, and it has been 7 days since the final dose.

Government-nominated accommodation means a hospital, hotel or other accommodation premises at which the person is directed to quarantine by an emergency officer (public health) at which the Queensland Government provides a security and health overlay.

Hospital means:

  1. a hospital, as defined in schedule 2 to the Hospital and Health Boards Act 2011; or

  2. a private health facility, as defined in section 8 of the Private Health Facilities Act 1999; or

  3. a multi-purpose service, as defined in section 104 of the Subsidy Principles 2014 made under section 96-1 of the Aged Care Act 1997 (Cth).

International air crew means a person whose primary place of residence is not in Queensland and who does not enter Queensland on a quarantine-free flight who is:

  1. an air crew member actively servicing an inbound flight to Australia; or

  2. an off-shift air crew member travelling to reposition to commence duty in Australia; or

  3. an aeromedical services crew member providing patient transport or emergency medical care to a patient; or

  4. an off-shift aeromedical services crew member who is travelling as a passenger on an aircraft to reposition to commence duty in Australia.

Note: Air crew servicing quarantine-free flights to Queensland from a safe-travel zone country are not required to quarantine under this Direction.

Isolate means:

  1. the person is to travel directly to premises that are suitable to reside in and remain in those premises until a negative test result is received and they are symptom-free; or

  2. travel directly to, or remain at, a hospital for medical treatment, and following treatment and discharge from the hospital, travel directly to premises that are suitable to reside in and remain in those premises until a negative test result is received and they are symptom-free; and

  3. must not leave the premises except to:

    1. obtain essential medical care or essential medical supplies where alternative delivery arrangements are not reasonably practicable;

    2. avoid injury or escape a risk of harm; or

    3. in the event of an emergency situation; or

    4. as otherwise permitted or required under a direction given by the person by an emergency officer (public health); and

  4. must wear a surgical mask whenever directed to do so by an emergency officer (public health) and when leaving isolation as permitted by paragraph (c), unless it is not practicable because of the emergency situation or the need to avoid immediate injury or risk of harm.

Member of positioning crew means a person who:

  1. is identified as a member of positioning crew:

    1. in the flight manifest of the flight on which the person arrived in Queensland; or

    2. by the person’s employer or the airline the person will be flying for in the form approved by the Chief Health Officer; and

  2. has documentary evidence of the flight, including the date of the flight, on which the person left, or will leave Australia; and

  3. can provide an undertaking that they only left Australia for the purpose of servicing an inbound or outbound flight and did not undertake any other activities while in a place outside of Australia, including participating in regulatory training.

    Notes: A person who travelled overseas to undertake regulatory training cannot be considered a member of a positioning crew. A person entering Queensland to undertake regulatory training cannot be identified as a member of positioning crew.

Nominated premises means:

  1. a person’s allocated room within government-nominated accommodation as directed by an emergency officer (public health); or

  2. air crew accommodation; or

  3. for Queensland-based international air crew engaged by an approved airline, the air crew’s residence; or

  4. for Australian Defence Force air crew, the air crew’s residence or military base; or

  5. another premises as directed by an emergency officer (public health).

Operational Guidelines for Air Crew means the Operational Guidelines for Air Crew approved by the Chief Health Officer and published on the Queensland Government website.

Physical distancing includes remaining at least 1.5 metres away from other persons where possible.

Private transport means:

  1. a private vehicle; or

  2. if travel by (a) is not available or practicable, an endorsed transport provider.

    Note: An airline operator should ensure air crew travel to and from their residence by private vehicle whenever practicable.

Quarantine facility worker has the same meaning as in the Requirements for Quarantine Facility Workers Direction (No. 4) or its successors.

Quarantine-free flight means a flight:

  1. that only carries passengers who have completed an Australian Travel Declaration at least 72 hours prior to departure declaring details of their health status and that they have been in a safe travel zone country for 14 days or more and have not been in a safe travel zone country hotspot; and

  2. where no air crew have been in a COVID-19 hotspot or safe travel zone country hotspot in the 14 days prior to entering Queensland.

Note: Information about quarantine free flights is available from the Australian Department of Home Affairs: https://covid19.homeaffairs.gov.au/new-zealand-safe-travel-zone. Determinations about quarantine-free flights are made by the relevant airline.

Queensland-based international air crew means a person whose primary place of residence is in Queensland and arrives in Queensland on a flight that is not a quarantine-free flight and who is:

  1. an air crew member actively servicing an inbound flight to Australia; or

  2. an off-shift air crew member who can provide evidence that they are a member of positioning crew in the form approved by the Chief Health Officer; or

  3. an aeromedical services crew member providing patient transport or emergency medical care to a patient; or

  4. an off-shift aeromedical services crew member who can provide evidence that they are a member of positioning crew in the form approved by the Chief Health Officer.

Note: Ground crew are not included in the definition of Queensland-based international air crew unless they are actively servicing an inbound flight to Australia.

Relevant authority means Queensland Health or an agency contracted by the Queensland Government to undertake testing for COVID-19.

Example: Mater Pathology

Residence means premises used, or intended to be used, as a dwelling or mainly as a dwelling, and includes the land on which the residence is situated, and includes:

  1. a single detached dwelling; or

  2. each of one or more attached dwellings that are separated by a common wall;
    Examples for paragraph (b) — villa unit, townhouse, terrace house, row house, unit in an apartment block.

  3. a manufactured home as defined in section 10 of the Manufactured Homes (Residential Parks) Act 2003; or

  4. a caravan as defined in section 7 of the Residential Tenancies and Rooming Accommodation Act 2008; or

  5. any other building or structure situated on the same land as the premises or dwelling.
    Examples for paragraph (e) – pool house, granny flat.

but does not include an aged care residential facility, corrective services facility or detention centre.

Safe travel zone country has the same meaning as in the Quarantine for International Arrivals Direction (No. 18) or its successor.

Safe travel zone country hotspot has the same meaning as in the Quarantine for International Arrivals Direction (No. 18) or its successor.

Surgical mask means a single use surgical mask with a minimum level 1 barrier protection level under the Australian Standard (AS 4381:2015) that covers the nose and mouth.

Surveillance testing means testing for COVID-19 that:

  1. occurs when an air crew member is asymptomatic; and

  2. is facilitated by an airline operator and is made available to Queensland-based international air crew arriving in Queensland and is a COVID-19 PCR test unless a person can provide written evidence of a negative COVID-19 PCR test result undertaken in Queensland or another State or Territory in the 7 days immediately prior to entry and is repeated on a rolling 7-day testing cycle until the crew member leaves for their next international assigned flight duty, or has been in Australia for 14 days, whichever is shorter; and

  3. is facilitated by a relevant authority for international air crew on arrival in Queensland and is a COVID-19 PCR test unless a person can provide written evidence of a negative COVID-19 PCR test result undertaken in Queensland or another State or Territory in the 7 days immediately prior to entry and is repeated on a rolling 7-day testing cycle until the crew member leaves for their next assigned international flight duty or has been in Australia for 14 days, whichever is shorter; and

  4. occurs when requested by an emergency officer (public health); and

  5. occurs prior to onward domestic travel and is a COVID-19 test.

Symptoms consistent with COVID-19 means fever or history of fever, symptoms of acute respiratory infection (cough, shortness of breath, sore throat), loss of smell, loss of taste, runny nose, diarrhoea, nausea, vomiting or fatigue.

Unaccompanied minor is a child who is not in the presence of a responsible adult.
